At a glance: These Terms govern your purchase and use of HeartFirst products. They explain what you are buying, how digital delivery works, your refund and withdrawal rights, what you may and may not do with the products, and the limits of our educational role. If anything is unclear, contact us at heartfirst@shyntesy.com before purchasing.

1. Parties

Key point

This is a contract between you (the buyer) and Shyntesy (the seller). By completing a purchase, you agree to these terms.

These Terms & Conditions (“Terms”) constitute a legally binding agreement between:

  • You: purchasing or using HeartFirst products ("you", "your", "the buyer")
  • Shyntesy: developing and selling HeartFirst products ("Shyntesy", "HeartFirst", "we", "us", "our")

By completing a purchase of any HeartFirst product, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not complete the purchase.

These Terms apply to purchases made through our website at heartfirst.shyntesy.com and any associated payment processing checkout pages.

2. Products

Key point

We sell three digital education products. Each is complete on its own. They are educational tools, not medical services.

All listed products are individual purchases unless a product page clearly states otherwise before checkout. There are no recurring charges for these products. Where community or members-area access is included, the product page will explain the access period and any conditions.

Product descriptions on our website form part of the contract. If a product does not match its description, you have the right to a refund under these Terms.

3. Purchasing

Key point

You buy through a payment processor. Prices are in euros. The contract is formed when your payment is confirmed.

Purchases are processed by PCI-compliant payment providers such as Stripe and, where available, PayPal. We do not store your payment card details. By purchasing, you may also be subject to the applicable payment provider’s terms and privacy policy.

Prices are displayed in euros (€). Any applicable taxes will be shown at checkout where required. Prices are correct at the time of display and may change for future purchases, but will not change for an order already placed.

A binding contract between you and Shyntesy is formed when a payment processor confirms your payment and we send you an order confirmation email. The contract is formed in English.

You must provide accurate personal information, including a valid email address, at the time of purchase. We use your email address to deliver your product. Providing a false email address that prevents delivery does not entitle you to a refund.

4. Delivery

Key point

Your product is delivered by email immediately after payment. If you don’t receive it within a few minutes, check spam or contact us.

Digital products are delivered by email to the address provided at checkout, typically within minutes of payment confirmation. Delivery is also confirmed on the post-purchase page shown immediately after checkout.

If you do not receive your product within 30 minutes of purchase, please:

  1. Check your spam or junk folder
  2. Check that the email address you provided at checkout was correct
  3. Contact us at heartfirst@shyntesy.com with your order email address and we will resend the product

Delivery failures caused by an incorrect email address provided at checkout, a full inbox, or overly restrictive spam filters do not entitle you to a refund. We will make reasonable efforts to resend the product if you contact us.

For HeartFirst Prevent, the private 30-minute preparation session is not delivered at the time of purchase. A booking link is provided in your confirmation email. Sessions are offered by appointment, typically within 3–5 business days of purchase.

5. Right of Withdrawal — EU and UK Consumers

Key point

EU and UK law gives you a 14-day cooling-off period for digital purchases. Because you get instant access, we ask you to waive that right at checkout so we can deliver immediately. If you don’t waive it, delivery is delayed 14 days. Either way, our 30-Day Guarantee gives you better protection than the legal minimum.

Under EU Consumer Rights Directive (2011/83/EU) and equivalent UK legislation, consumers normally have a 14-day right of withdrawal from purchases of digital content without giving any reason.

However, this right does not apply to digital content that has already been supplied with the consumer’s prior consent and acknowledgement that the right of withdrawal is thereby lost. At checkout, you are presented with a clear request to:

  1. Consent to immediate delivery of the digital product
  2. Acknowledge that by consenting to immediate delivery, you lose your 14-day right of withdrawal under applicable consumer law

Because our products are digital and normally delivered immediately, checkout may require you to consent to immediate delivery and acknowledge that your statutory withdrawal right is lost once delivery begins. If you do not wish to provide this consent, please do not complete the purchase.

This statutory right of withdrawal is separate from and does not affect our 30-Day Clarity Guarantee, which provides broader protection and applies regardless of whether you waived the statutory right.

This clause applies to consumers in the European Economic Area and the United Kingdom. It does not apply to business purchasers.

6. Refunds and the 30-Day Clarity Guarantee

Key point

If the product hasn’t delivered what it promised within 30 days, email us and we refund you in full. No questions. We also credit prior purchases when you upgrade.

Our 30-Day Clarity Guarantee operates as follows:

  • If, after working through your HeartFirst product, you do not feel meaningfully more informed and better prepared for your next clinical conversation, you are entitled to a full refund
  • Requests must be made within 30 days of the purchase date
  • To request a refund, email heartfirst@shyntesy.com with your order email address. No further explanation is required.
  • Refunds are processed within 3 business days via the payment processor to the original payment method
  • Upon refund, your licence to use the purchased product is revoked

The Guarantee covers educational value, not health outcomes. We do not guarantee any change to your health, test results, clinical diagnosis, or treatment plan as a result of using our products. We guarantee that you will feel more informed and better prepared for a clinical conversation. These are distinct and the distinction is intentional.

Prior purchase credits

If you have previously purchased a lower-tier HeartFirst product and subsequently purchase a higher-tier product, we apply your prior purchase price as a credit against the higher-tier price. To claim a credit, email us at heartfirst@shyntesy.com before completing the upgrade purchase.

Credits are not transferable and cannot be applied retroactively to purchases already completed without prior agreement.

Outside the Guarantee period

After 30 days from purchase, we are not obliged to provide a refund except where required by applicable consumer law (for example, where a product materially fails to match its description). We assess such requests on a case-by-case basis.

7. Educational Use Only — Not Medical Advice

Key point

Our products are educational tools. They are not medical advice. They do not replace your doctor. All clinical decisions belong with a qualified health professional.

All HeartFirst products are provided for educational and organisational purposes only.

HeartFirst products are not:

  • Medical advice, clinical advice, or health advice in any form
  • A diagnosis of any medical condition
  • A treatment plan or treatment recommendation
  • A substitute for consultation with a qualified health professional
  • A guarantee of any health outcome, test result, or clinical finding

Use of HeartFirst products does not create a health professional-patient relationship, a clinical relationship, or any duty of care between Shyntesy and the buyer.

All decisions about testing, medication, monitoring, imaging, lifestyle changes, and treatment must be made by a qualified health professional with knowledge of your full clinical picture. Our products help you prepare for those conversations — they do not replace them.

If you are experiencing symptoms that may represent a medical emergency — including chest pain, shortness of breath, stroke symptoms, or any condition that may be urgent — stop using this product and seek emergency medical care immediately.

8. Permitted Use

Key point

You can use the product for yourself, print it, bring it to appointments, and share short excerpts with credit. You cannot resell it, repackage it, or pass it off as your own.

Upon purchase, we grant you a personal, non-exclusive, non-transferable licence to use the HeartFirst product you have purchased for the following permitted purposes:

  • Personal educational use to organise your own cardiovascular risk information
  • Printing a personal copy for your own use
  • Bringing completed worksheets or the Clarify Snapshot to your own health-team appointments
  • Sharing short excerpts (under 100 words) for non-commercial educational purposes, with attribution to HeartFirst by Shyntesy
  • Sharing the At a Glance Briefing Card with family members, friends, or health-team contacts for non-commercial educational purposes, with attribution

The following are not permitted without our prior written consent:

  • Reselling, sublicensing, or distributing the product to any third party
  • Reproducing, copying, or sharing the full product or substantial portions of it
  • Uploading the product to public file-sharing platforms, course platforms, or any online repository
  • Rebranding, adapting, or presenting the product as your own creation
  • Using the product as part of a commercial offering — for example, as content within a paid course, coaching programme, or professional service — without a commercial licence
  • Removing or obscuring HeartFirst by Shyntesy branding, copyright notices, or educational disclaimers

9. Intellectual Property

Key point

We own the products. Buying one gives you a licence to use it — it does not transfer ownership.

All HeartFirst products, including their text, structure, tools, worksheets, frameworks, templates, design, and branding, are the intellectual property of Shyntesy and are protected by copyright law.

Purchasing a HeartFirst product transfers a personal use licence to you. It does not transfer ownership of any intellectual property. All rights not expressly granted in these Terms are reserved by Shyntesy.

The HeartFirst name, the Clarify → Navigate → Prevent framework, the Known / Unknown / To Discuss methodology, and associated branding are proprietary to Shyntesy.

10. Limitation of Liability

Key point

Our liability to you is limited to what you paid. We are not liable for health outcomes — because our products are educational tools, not clinical services. Nothing here removes your statutory consumer rights.

To the fullest extent permitted by applicable law, Shyntesy’s total liability to you in connection with any HeartFirst product — whether in contract, tort (including negligence), statute, or otherwise — shall not exceed the price you paid for the product giving rise to the claim.

Shyntesy is not liable for:

  • Any health outcome, clinical outcome, or medical decision made in connection with use of our products
  • Any loss arising from reliance on product content as medical advice (it is not medical advice)
  • Any indirect, consequential, or special loss
  • Any loss arising from your failure to seek appropriate medical care
  • Technical issues outside our control, including email delivery failures caused by your email provider

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable consumer protection law.

Your statutory rights as a consumer are not affected by these Terms. In particular, if you are a consumer in the EU or UK, your rights under applicable consumer protection legislation remain intact.

11. Data and Privacy

Key point

We collect only what we need to deliver your product. We don’t sell your data. Full details are in our Privacy Policy.

Shyntesy processes your personal data in accordance with our Privacy Policy, which forms part of this agreement.

As the data controller, Shyntesy is responsible for the lawful processing of your personal data. We collect your email address and name to deliver the product, process your payment via payment processors, and send the post-purchase email sequence. We do not sell your data or use it for advertising.

12. Private Preparation Sessions (HeartFirst Prevent)

Key point

The 30-minute session is a structured preparation service, not a medical consultation. It doesn’t create a clinical relationship. It must be booked within 90 days of purchase.

HeartFirst Prevent includes one private 30-minute preparation session. The following terms apply specifically to this component:

  • The session is a structured preparation and review service, not a medical consultation, clinical assessment, or health service of any kind
  • The session does not create a health professional-patient relationship or any clinical duty of care
  • Session content is based on your completed Clinician Briefing Template and is provided for educational preparation purposes only
  • Sessions must be booked within 90 days of the purchase date using the booking link in your confirmation email.
  • Sessions should be booked within 90 days of purchase using the booking link in your confirmation email. Sessions not booked within this period may be forfeited, unless otherwise agreed with us or required by applicable law.
  • Cancellations with less than 24 hours’ notice may result in the session being treated as used, unless there are exceptional circumstances or applicable law requires otherwise.
  • Sessions are offered by voice or video call. Technical failure on your end (poor internet connection, incompatible device) does not entitle you to a replacement session unless we are responsible for the failure
  • Sessions are conducted in English

13. Changes to These Terms

Key point

We may update these Terms. If we do, the Terms that applied when you purchased are the ones that govern your purchase — not any later version.

We reserve the right to update or amend these Terms at any time. Updated Terms will be published at this URL with a revised “Last updated” date.

Changes to these Terms do not affect purchases already made. The Terms in effect at the time of your purchase govern that transaction. New purchases after an update are governed by the updated Terms.

We will not notify existing customers of minor clarifications to the Terms. Material changes that affect existing customers’ rights will be communicated by email where we hold your contact details.

14. Governing Law and Disputes

Key point

These Terms are governed by the laws of your land. If you are an EU consumer, you also have the protection of the consumer laws of your country of residence.

These Terms and any dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction over any dispute.

If you are a consumer resident in a European Union member state, you also benefit from any mandatory provisions of the consumer protection law of your country of residence that provide you with greater protection than these Terms. Nothing in these Terms limits those rights.

If you are an EU consumer, you may have access to national consumer redress or alternative dispute resolution bodies in your country of residence. The former European Commission Online Dispute Resolution platform was discontinued on 20 July 2025. We encourage you to contact us first so we can try to resolve the issue directly.

Before initiating any formal dispute process, we encourage you to contact us directly. We resolve the large majority of concerns by email within 2 business days.
